Nevada Overtime and Meal & Rest Break Laws for Nurses

Under Nevada Revised Statute Annotated section 608.018, employees are provided mandatory overtime pay for hours worked in excess of eight in one work day. Mandatory overtime is also required if an employee works longer than 40 hours in one workweek. These state requirements include additional caveats such that the overtime protections afforded to workers only apply to those earning less than 1 ½ times the minimum wage. The currently minimum wage in Nevada is $8.25/hour. Thus, overtime laws do not apply to any worker earning greater than $12.38/hour. In addition, if the worker agrees to a flextime schedule of four 10-hour days, the overtime laws do not apply. If an employee finds himself or herself uncovered by the Nevada statutes, the federal Fair Labor Standards Act would fill in the gaps to provide guidance with respect to overtime laws. The federal standards require the same mandatory overtime for those working longer than 40 hours per week but do not require overtime pay for work in excess of 8 hours per day.

Under the Nevada Revised Statutes Annotated section 608.019, which applies to employers of two or more employees, workers are entitled to a meal break of 30 minutes for 8 consecutive hours of work. Ten-minute rest breaks are also mandatory and must be paid for each four hours of work as practicable. The break should be taken in the middle of the work period and this requirement does not apply to employees whose total daily work time is less than 3 ½ hours.
