Missouri Overtime and Meal & Rest Break Laws for Nurses

Under Sections 290.500 and 290.505 of the Missouri Revised Statutes, employees are entitled to mandatory overtime pay for work in excess of 40 hours in one workweek. State and federal statutes define a workweek as seven consecutive days including weekends. The workweek typically begins on a Monday but can be defined in any other way by the employer as long as the beginning day and end day of the workweek are consistent throughout each month. Overtime pay is calculated as hourly time plus one-half. Thus, if a nurse typically earns $10/hour, he or she would earn $15 in overtime.

Missouri has not enacted specific legislation with respect to meal and rest breaks. Meal breaks are those which typically last 30 minutes or longer and rest breaks are short personal breaks lasting no longer than 20 minutes. In any situation in which a state statute has not covered an employment or labor-related issue, the federal Fair Labor Standards Act (FLSA) fills in the statutory gaps. Unfortunately, the current version of the FLSA does not mandate that an employer must provide paid or unpaid meal or rest breaks. However, if an employer agrees to provide short breaks (20 minutes or less) those breaks must be compensable. Employers are within their legal rights to require nurses to eat while on duty if the nature of the employment so requires.
