Mississippi Overtime and Meal & Rest Break Laws for Nurses

Mississippi law does not expressly address issues of mandatory overtime for employees. In any situation where state law does not adequately cover employment and labor issues, the federal Fair Labor Standards Act (FLSA) is implicated to fill in any gaps. Under the FLSA, which typically applies to nurses, employers must provide mandatory overtime pay for workers clocking greater than 40 hours in one workweek. A workweek is defined in the FLSA as seven consecutive days including weekends. Traditionally, the workweek begins on Monday but employers are free to define the workweek as they see fit for their business- however the workweek must be consistent and employers cannot manipulate the definition to avoid paying overtime. The FLSA does not require mandatory overtime for work on Sundays or holidays unless work on those days would cause the employee to surpass the 40-hour maximum.

Mississippi has not enacted any state statutes with respect to meal or rest breaks- which means the FLSA will provide employers with guidelines in these areas. Unfortunately, the FLSA does not provide employees with many options with respect to mandatory rest and meal breaks. Employers are under no legal duty to provide either and may even require employees to eat while on duty if required by the nature of the job. Employers are not required to pay employees for meal breaks of 30 minutes or more. If an employer agrees to provide short rest breaks, typically 20 minutes or less, these breaks must be paid.
