Connecticut Overtime and Meal & Rest Break Laws for Nurses

Under sections 31-76(b) and 31-76(c) of the Connecticut General Statute Annotated, employees are guaranteed time and one-half pay after performing more than 40 hours of work within one seven-day period. The legislature also requires “premium pay” for work performed on weekends, holidays or the 6th and 7th consecutive day of work. “Premium pay” is a pay amount above and beyond the agreed-upon salary that provides extra compensation for employees working on holidays or weekends but is not necessary time and one-half pay. “Premium pay” amounts are unique to each employment contract and are reviewed with the nurse upon hiring.

Under sections 31-51ii and 31-40w of the Connecticut General Statute Annotated, nurses must be provided one 30-minute unpaid meal break after the first two hours of work and before the last two hours of work for those who work 7 1/2 –hour shifts or longer. The employee may treat the meal break as a rest break if he or she desires and may take the 30-minute paid period instead of a meal break.
