Arizona Overtime and Meal & Rest Break Laws for Nurses

Arizona law adheres closely to the Fair Labor Standards Act (FLSA) and provides for overtime payment of regular hourly wage plus one-half hour wage for hours worked beyond 40 in any seven-day increment. Like the federal rules, Arizona does not recognize mandatory overtime for hours surpassing eight in anyone one work day. Arizona sets the overtime minimum wage at $11.20 per hour.

Arizona has not enacted special legislation with regard to meal and rest breaks. Nurses are not entitled to compensable meal breaks and short personal breaks (usually lasting 5-20 minutes) are only compensable if agreed upon with the employer. Otherwise, breaks are unpaid at the expense of the nurse as the federal rules do not require employers to pay nurses for time spent away from the job.
